A) Use of the Site

2) Acceptance of the Terms

By accessing the Site, browsing it, submitting forms (RFQ/samples) or placing an order, you accept these Terms. If you do not agree, do not use the Site or our Services.

3) Eligibility and permitted use

  • The Site may be used by businesses/professionals (B2B) and by consumers (B2C).

  • You undertake to use the Site lawfully and not to carry out any activity that may damage, disable or overload the Site, nor to attempt unauthorised access to systems, data or accounts.

4) Registration, verification and access to content (if applicable)

Curador may enable registration or verification to access certain features or information (for example, documentation, prices, advanced availability or technical content). You undertake to provide truthful and up-to-date information. Curador may suspend or cancel access in the event of misuse, fraud or breach of these Terms.

B) Products, lots and nature of green coffee

5) Nature of the product

Green coffee is an agricultural product. The characteristics of each lot may vary (for example, sensory profile, moisture, water activity, defects, etc.). The information on the Site (spec sheets, cupping notes, farm stories, images or descriptions) is provided for information purposes and refers to the lot indicated.

6) Spec sheets, availability and updates

  • The availability of lots, volumes and statuses (“Available/Incoming/Reserved/Sold”) may change.

  • Curador makes reasonable efforts to keep information up to date, but updating or typographical errors may occur.

  • Curador may correct information, update statuses, adjust volumes or withdraw lots from the catalogue where necessary.

C) Sales process and contracting (B2B/B2C)

7) Purchase process (sales-led)

The typical purchase process at Curador Green is sales-led:

  1. Request for quotation (RFQ) and/or sample request

  2. Confirmation of availability, volume, terms and place of delivery (DAP)

  3. Issue of offer/order confirmation or contract

  4. Payment in accordance with the agreed terms

  5. Logistics coordination and delivery

8) Formation of the contract

A request (by form, email or any other channel) does not constitute automatic acceptance.

The sale and purchase contract is deemed concluded when Curador:

  • issues a written order confirmation (email/document), and/or

  • processes payment in accordance with the offer/confirmation.

Curador may reject requests on reasonable grounds (for example, lack of availability, compliance risks, material errors in price or information, or operational reasons).

9) Prices, currency and taxes

  • Prices may be shown as POA (Price on request) or communicated by offer/confirmation.

  • Unless otherwise stated, prices are expressed in EUR.

  • Applicable taxes (VAT or others) will be set out in the offer/confirmation and/or invoice, in accordance with applicable regulations.

10) Payments

The available payment methods will be indicated in the offer/confirmation or on the Site. Curador may require payment in advance to confirm transactions, especially for B2C sales and/or transactions from origin.

11) Cancellations

  • Before order confirmation, Curador may cancel requests due to lack of stock or other reasonable grounds.

  • After confirmation, cancellations or modifications will be governed by the terms agreed in the confirmation/contract and by the applicable policies.

D) Delivery and logistics (DAP) — warehouse in Europe or origin

12) DAP Incoterm and place of delivery

Unless otherwise agreed in writing, deliveries are made under the DAP (Delivered At Place) Incoterm to the place indicated by the customer in the order confirmation.

13) Unloading

Unloading is always the customer’s responsibility, unless otherwise agreed in writing.

14) Delivery times

Delivery times are estimates and depend on:

  • the point of dispatch (the place where the agreed inventory is located: warehouse in Europe or origin),

  • the availability of the lot,

  • logistics conditions and carriers.

Curador shall not be liable for delays caused by third parties (carriers), customs (if applicable), weather conditions, strikes or other circumstances beyond reasonable control (see force majeure).

15) Receipt and inspection

The customer must inspect the shipment upon receipt and report any issues in accordance with the Returns, Claims and Refunds Policy — Green Coffee (DAP) published on the Site. Failure to report within the established time limits may constitute acceptance of the shipment, except for demonstrable hidden defects.

E) Returns, claims and refunds

16) Applicable policy

Returns, claims and refunds are governed by our Returns, Claims and Refunds Policy — Green Coffee (DAP), which is incorporated into these Terms by reference.

F) Customer obligations: storage, traceability and handling

17) Storage and handling

From DAP delivery onwards, the customer is responsible for:

  • proper storage (humidity, ventilation, temperature and absence of odours),

  • preservation of traceability (labels and lot references),

  • correct handling of the product.

Curador is not liable for deterioration attributable to handling or storage after delivery.

18) Lot integrity

For any claim, the customer undertakes to:

  • preserve the lot identification,

  • not repack, blend or alter the product before the verification process has been completed (if non-conformity is suspected).

G) Warranties and limitation of liability

19) Legal guarantees (B2C)

If you purchase as a consumer (B2C), the legal guarantees applicable under current regulations apply to you. In any case, the nature of the product and the conditions of integrity, traceability and storage after delivery will be taken into account.

20) Limitation of liability

To the extent permitted by law:

  • Curador shall not be liable for indirect losses (loss of profit, loss of production, loss of business, loss of opportunities or reputational damage).

  • Curador’s total liability for any claim shall not exceed the amount actually paid for the specific product that is the subject of the claim.

(For B2C, this clause is without prejudice to the consumer’s non-waivable rights.)

21) Force majeure

Curador shall not be liable for non-performance or delays due to events beyond reasonable control, including, without limitation: logistics disruptions, strikes, natural disasters, war, decisions of authorities, supply outages, fires, floods or widespread failures of suppliers/carriers.
